I. SURVEY PRIZE DRAW

1. The organizer of the prize draw is "Enscape GmbH, An d. RaumFabrik 33b, 76227 Karlsruhe ("Organizer").

2. The Organizer's decision to hold the Architizer Survey Prize Draw (“Prize Draw”) under these rules is final and binding on the Organizer.

II. PRIZE DRAW DURATION

3. The period during which anyone can participate in the Prize Draw starts on Monday May 29 with a start time of 15:00 (CET) and will continue until Friday June 6 with an end time of 23:00 PM (CET) unless there is a change according to paragraph 20. 

III. TERRITORIAL SCOPE OF THE PRIZE DRAW

4. THIS PRIZE DRAW IS VOID WHERE PROHIBITED BY LAW. OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES OF AMERICA (EXCLUDING PUERTO RICO AND ITS OTHER TERRITORIES AND POSSESSIONS), CANADA (EXCLUDING THE PROVINCE OF QUEBEC), THE UNITED KINGDOM, AUSTRALIA, AUSTRIA, BELGIUM, CZECH REPUBLIC (CZECHIA), FINLAND, FRANCE, GERMANY, IRELAND, JAPAN, NEW ZEALAND, MAINLAND CHINA (EXCLUDING HONG KONG AND MACAU), NORWAY, POLAND, SPAIN, SWITZERLAND, SOUTH KOREA, TAIWAN, THE NETHERLANDS, BULGARIA, CROATIA, CYPRUS, DENMARK, ESTONIA, GREECE, HUNGARY, ITALY, LATVIA, LITHUANIA, LUXEMBOURG, MALTA, PORTUGAL, ROMANIA, SLOVAKIA, SLOVENIA, SWEDEN, BRAZIL, MEXICO.

IV. RIGHT TO PARTICIPATE IN THE PRIZE DRAW

5. Every person being 18 years of age or older has the right to participate in the Prize Draw as long as they are eligible according to section III and have followed the rules in section V. Entrants warrant that they are not prohibited by employment, contract, law, regulation, or any applicable professional code of conduct from accepting a gift from the Organizer.

6. Participants are not required to be citizens of or reside on the territory of the Germany or any other country.

7. No employees or contractors of the Organizer, nor their families, shall have the right to participate in the Prize Draw.

8. By entering the Prize Draw you expressly consent to the Organizer's collection, processing and use of your personal information that you provide in connection with this Prize Draw or accompanying Architizer Survey and under the terms of the Organizer’s privacy statement, which can be accessed at https://enscape3d.com/privacy/.

V. RULES OF THE PRIZE DRAW

9. To participate in this Prize Draw, you must participate in the Architizer Survey, which can be accessed at https://architizer1.typeform.com/to/rfqpQqtb. 

Each entrant is limited to one participation in the survey.

The winner will be randomly drawn by a representative of the Organizer, whose decision will be final.

10. Each Participant who has successfully participated in the Prize Draw during the respective time has the opportunity to win an Amazon* Voucher in value of USD 500,00.

11. The Organizer reserves the right to substitute the prize with any article or service of similar or greater value at its sole discretion.

12. Prize(s) may not be assigned or transferred. Replacement of prizes won against cash or other benefits or rights will not be made.

13. All Participants having taken part in the survey during the validity period participate in the prize draw, which will be done randomly among all those who have participated in the survey.

14. The winner will be contacted via email, provided a valid email address has been provided.

15. If, Participant fails to take due care of reacting, they lose their right to receive the prize and the Organizer has the right to withdraw a new winner in their place.

16. The Prize Draw organizer shall not be liable to the relevant person, the actual winner of the drawing, in case of fraud by unscrupulous persons.

17. The Organizer reserves the right at all times at its sole discretion to cancel, terminate, modify or suspend the Prize Draw and these Terms, in whole or in part, in the event of any cause beyond the reasonable control of the Organizer that interferes with the proper conduct of the Prize Draw as contemplated by these Terms, including, without limitation, any error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, or any other cause.

VI. PUBLICITY OF THE PRIZE DRAW AND USE OF THE INFORMATION

18. These terms and conditions will be publicly available and available for the entire duration of the Prize Draw on the Organizer's website at: https://www.chaos.com/architizer-2023/terms where everyone interested should become acquainted with them.

19. THE INFORMATION FILLED BY THE PARTICIPANTS IN THE QUESTIONNAIRE WILL BE PROCESSED BY THE ORGANIZER, FOR ORGANIZER’S OWN PURPOSES.
VII. LOSS OF RIGHT TO PARTICIPATE IN THE PRIZE DRAW
20. Each of the Participants is responsible for the accuracy of the data provided by him/her in connection with his/her participation in the Prize Draw. The Organizer reserves the right to exclude participants, at any time and without notice, who use multiple email addresses or accounts, or such like, to increase their chances of winning, to technically tamper with the contest, the selection process or otherwise, to oppose these terms and conditions. The participation of contest agencies and other automatically generated mass mailings is expressly excluded when determining the winner.

VIII. LIMITATION OF LIABILITY
21. The Organizer shall not be liable to the relevant Participant, the actual winner of the prize, if the provided e-mail/shipping address is wrong or any type of fraud is committed by a third party in regard to the provided e-mail address and the access to it. The participation in the Prize Draw is voluntary and free and does not create any rights for the Participants to receive something in return or obligations to the Organizer to provide something to the Participants. To the extent that the Organizer is claimed against for inappropriate content or other breaches of law which are to be represented by the participant, the participant shall release the Organizer on first request and assist the Organizer in the defense of the claims. This shall include legal-proceedings costs.

IX. PERSONAL DATA

22. Grounds for processing personal data is based on legitimate interest of the data controller. The purpose for processing personal data is selecting/drawing, rewarding and informing the winners of marketing competitions and prize draws. The data can also be used for designing and developing of the Organizer´s business, products and services. 

Personal data processed includes the following personal data of the participants: • Basic information: First name, last name • Contact information: mailing address, email address, telephone number • Information necessary for the competition/prize draw, such as participation information (incl. date), 

The data is collected from the information obtained from the data subject when participating in a competition or prize draw. There are no other sources of information. 

Personal data may be disclosed and transferred within the Marimekko group and to partners or service providers also outside the EU/EEA area for the purpose for processing personal data disclosed in this privacy statement. If personal data is transferred outside the EU/EEA, we will ensure that appropriate contractual measures (e.g. using standard contractual clauses of the EU Commission) are applied to the transfer, the transfer is lawful and that the processing and confidentiality are in compliance with the applicable laws. 

The data file can only be accessed by specified persons to the extent of their duties. 

The data is retained for as long as it is necessary for choosing/drawing the winner(s), informing the winner(s) and delivering of the possible prize.

X. TERMINATION

24. The Organizer has the irrevocable right to change the terms or terminate the Prize Draw at any time by announcing it on its website at https://www.chaos.com/architizer-2023/terms. 

XI. FINAL PROVISIONS

25. The Organizer reserves the right to cancel, suspend and/or modify the contest at its sole discretion. By participating in the contest, entrants agree to release and hold harmless the Organizer from and against any claim or cause of action arising out of participation in the contest, including any errors in the administration of the promotion, printing errors and technical errors, and the winner and his or her entry agree to release and hold harmless the Organizer as well from receipt or use of any prize awarded, and further agrees to the disclosure of the name of the winning entry. Any change in the deadlines for withdrawing and submitting the gifts of this Prize Draw will be duly published on the Organizer's website at https://www.chaos.com/architizer-2023/terms.

26. These Official Rules are governed by, and must be construed in accordance with, the laws of Germany. Entrants agree that all disputes arising from or in connection with this contest and the prize awarded must be heard in a German court. This contest is void where prohibited by law.
